Performance Reconsideration & Grievance Transfers

Performance reconsideration requests are no longer being processed under the Negotiated Grievance Procedure (NGP). However, management has confirmed to GESTA that affected employees may instead transfer their reconsideration requests to NASA’s Administrative Grievance System (AGS), as outlined in NPR 3771.1A.

To do so, employees must submit a formal request to the Acting HR Director, Ms. Leah Hollander. Employees may also designate a representative, and both the grievant and the representative will be entitled to official (government paid) time to prepare and participate in the matter. Under this process, reconsiderations of performance ratings will be filed directly at the formal stage (Step 2).

Timelines: Any grievance or reconsideration that was timely filed under GESTA's Collective Bargaining Agreement (CBA) will be considered timely under the AGS. The Labor Relations Office has so far not provided a deadline for requesting a transfer. 

GSFC Management’s current practice appears to be:

• To deny grievances that had already proceeded through Step 3 under the CBA and where arbitration was requested.
• To accept Step 1–3 grievances filed under the CBA that did not complete the full Step 3 process, which may now be transferred to AGS. CBA Step 1 grievances are being transferred to AGS Step 1 (informal) and CBA Step 2 or 3 will be transferred to AGS Step 2 (formal)
